The four PhD and registered PEs at Miller Engineering are celebrating 40 years of Professorships at three universities along with providing services to Government, Insurance, and Industry—through research, publications, presentations, and expert testimony. We have a dedicated office with a full time staff of engineers, researchers, and technical writers. James M. Miller, PE, PhD – Founder  Dr. Miller is an Emeritus Engineering Professor at the University of Michigan. He has directly served in Washington originating several Federal OSHA safety regulations, and interacts regularly with CPSC regarding safety and product recalls. Dr. Miller often works on projects relating to compliance with occupational safety standards, provides upper management guidance on product design, recall and liability issues, and serves as an expert witness.

Mark R. Lehto, PhD – Co-Founder Dr. Lehto is a Professor of Engineering at Purdue University. He completed his Ph.D. in engineering at the University of Michigan, where he specialized in Human Factors Engineering, in particular Warnings and Labeling. Dr. Lehto specializes in knowledge engineering, warnings and instructions, structuring expert systems, accident modeling, accident statistical analysis, consumer product safety, boating safety, in-field national surveys of product usage, and product information effectiveness.

David R. Clark, PE, PhD – Co-Founder Dr. Clark is an Emeritus Engineering Professor at Kettering University. He was an engineering PhD graduate from the University of Michigan, where he specialized in human factors engineering and system safety analyses. He has a special expertise in electrical fire- and explosion-related accidents, and has extensive experience working for loss control companies, performing over 150 fire origin and cause investigations in the past few years.

Adam M. Olshove, PE, MSE – Engineering Manager Mr. Olshove has over 10 years of experience providing consulting services to industry and the legal profession. He holds an MS in Mechanical Engineering with a focus on control systems and battery modeling (2019), and a BS in Mechanical Engineering (2012), both from the University of Michigan. He has performed dozens of on-site investigations nationwide in relation to consumer product design and industrial accidents, including failure analysis and testing.

Jeffrey D. Rupp, MSE – Engineering Associate Mr. Rupp has a BS in mechanical engineering from the University of Michigan and a MS in systems engineering and engineering management from Wayne State University. Among his company affiliates is 26 years with Ford Motor Company and Volvo Car Corporation, where he was involved in crash development and crash sensing calibrations.

Richard "Pete" Burgess provides service as an Aviaton Consultant for air traffic services, procedures, pilot experience and aircraft accident investigations. Mr. Burgess has been the Owner of Burgess Aviation Consultants since 1994 and specializes in the analysis of FAA Air Traffic Control service and the application of procedures in the following areas:

• Air Route Traffic Control Centers (ARTCC's)
• Airport Traffic Control Towers (ATCT's)
• Terminal Radar Approach Control Facilities (TRACON's)
• Automated Flight Service Stations (AFSS's)
• Detailed Transcript Preparation of Air Traffic Recordings

Mr. Burgess is an Instrument-Rated Commercial Pilot and Certified Flight Instructor for Multi/Single Engine airplane. He has over 4000 hours of flight time. 

EXPERIENCE

     5/94- Present   Burgess Aviation Consultants begins the twenty-fifth year specializing in the review and analysis of air traffic procedures in Air Route Traffic            Control Centers, Contract Control Towers, Airport Traffic Control Towers, Terminal Radar Approach Control’s and Automated Flight Service Stations.                  Have provided services as an Aviation consultant in over 276 different cases during the past twenty-four years. I have been deposed in 82 cases and testified          in 34 trials

      1972 to 1994 Air Traffic Control Supervisory and Management - FAA

• Managed and supervised the National evaluations of over 160 FAA air traffic ARTCC's, ATCT's, TRACON's and AFSS's facilities in Southern California, Nevada, Arizona, New Mexico, Missouri, Kansas, Texas, Oklahoma, Louisiana, Mississippi and Alabama
• Qualified on all positions of operation and actively controlled traffic as supervisor and manager at El Paso and Little Rock ATC Tower and radar approach control facilities
• Served as consultant and expert witness in trials involving aircraft accidents and enforcement actions in St. Louis, Kansas City and Little Rock
• Investigated the application and effectiveness of air traffic control procedures at Dallas/Fort Worth, Los Angeles and Kansas City Airports, as a result of major accidents at those airports

John V. Sabel is a retired Boeing 787 Captain with a Part 121 air carrier and an attorney. His more than 47 years in the aviation industry include experience as a check airman, FAA Aircrew Program Designee, and member of his pilot union's Safety and Accident Investigation Committees. 

John has logged over 23,000 flight hours in domestic and international operations and holds type ratings in the EMB-110, DC-9/MD-80, B-737, B-757/B-767, B-787, A-319/A-320/A-321; Flight Engineer certificate; Certified Flight Instructor certificate; Ground Instructor certificates; and Remote Pilot Small Unmanned Aircraft System certificate.

John has participated in NTSB accident investigations as a member of his pilot union's safety committee. He was a member of the 2011 Air Carrier Safety and Pilot Training Aviation Rulemaking Committee. He teaches Aviation Law, Aviation Safety, Aviation Regulations, Human Factors, Crew Resource Management, and other aviation courses as an adjunct faculty member at several universities.

Litigation Support - As an attorney with the expertise of an experienced airline transport pilot, John has the experience to examine technical issues and provide guidance and recommendations throughout all stages of litigation, from discovery through appeal.

Wayne J. Seiler, PhD, PE, is a Principal Engineer with All About Pavements Inc (API), with responsibility for Airport, Highway, and Port Pavement engineering and construction projects. With over 38 years of pavement engineering expertise, he is a Registered Professional Engineer in Minnesota, Illinois, North Carolina, Florida, Virginia, Maryland, and Mississippi.

Dr. Seiler has conducted pavement evaluations and developed numerous pavement designs for the reconstruction and rehabilitation of airports throughout the United States during his 38 year career. As a project manager, he has completed pavement evaluation, rehabilitation design, and pavement management work for several commercial airports, including BWI, Charlotte International Airport, Portland International Airport, Pittsburgh International Airport, O'Hare International Airport, Raleigh-Durham International Airport, Dayton International Airport, Wichita’s Mid-Continental Airport, and Montreal’s Mirabel and Dorval International Airports. These studies were accomplished through extensive records review, thorough investigations, pavement condition index surveys, nondestructive deflection testing, remaining life analyses, rehabilitation design using FAA procedures and more advanced mechanistic analyses, and life cycle cost comparisons.

In 2017, ASCE’s Transportation & Development Institute awarded Dr. Seiler with their national Airfield Pavement Practitioner Award. This award honors and recognizes practicing engineers employed in the airfield pavement engineering profession with demonstrated leadership and achievement in airfield pavement projects.

Litigation Support - Dr. Seiler has provided expert witness and expert consultant services to assist in the investigation of Pavement Failures that have occurred shortly after construction. Engineering services include data collection with Nondestructive Deflection Testing equipment and the use of local geotechnical laboratories at the project site.

To assist in legal case resolution, API owns two Falling Weight Deflectometers that can be used to successfully gather forensic data to complement his pavement expertise. Dr. Seiler recently helped the Cities of Concord and Manchester New Hampshire defend permitting fees that charge utility companies for constructing deep utility cuts that reduce the life of roadways in their cities. The case was successfully defended all the way to the New Hampshire Supreme Court after appeals by the prosecution.
