Recent new technology deployments with gigabit LTE at Telstra in Australia, Sprint in the U.S. and EE in the UK highlight how much mobile communications technologies have improved since the introduction of mobile data services with circuit-switched and then packet-switched offerings from around 20 years ago. Peak and average user speeds have increased by a factor of 10,000. By way of comparison, microprocessor performance doubling every couple of years, as predicted by Moore's Law, has increased it only one thousand-fold over that period. Cellular performance improvements are therefore quite spectacular given the vagaries of connecting through the ether up to hundreds of meters, as well as processing those signals in the confines of around one square centimeter of baseband processor silicon!
As an employment attorney, or perhaps as General Counsel for your organization, you have probably been fielding more and more questions about bullying in the workplace-we certainly have. While bullying isn't illegal - yet - you also probably know that it costs a lot in terms of its effect on production. Plus, you know it's not right-not really. So, what's the right approach? Our rule of thumb is not to overact to simple, appropriate work behavior, but you also can't put up with bullying either. Appraisal review isn't just for appraisers. While attorneys and CPAs may be best served by hiring a trained reviewer for questionable appraisals, they can do an initial pass using a quick checklist of a handful of common appraisal report mistakes. Common law negligence is established by plaintiff showing defendant owed plaintiff a legal duty, to conform to a standard of care, defendant breached that duty, plaintiff suffered injury and there is a causal relationship between the breach and injury.

Despite believability, it is one of the few crimes when the client is presumed guilty until proven innocent. On December 3, 1984, at a pesticide ingredient manufacturing facility owned by Union Carbide, a leak occurred in the Methyl Isocyanate (MIC) plant. Due to the toxic nature of the gases released and the plant's proximity to local residences, the death toll was in the thousands; both plant workers and nearby residents. The first recorded public meeting in response to this incident was on December 9th, in Institute, WV, the site of Union Carbide's only US MIC production unit. Full disclosure: my father was a research & development chemist for Union Carbide and Institute is about 10 miles down the Kanawha River from my hometown of Charleston, WV.

The public looks to safety professionals for guidance as experts in risk avoidance and hazard mitigation. This is reasonable as they are ostensibly trained in that area and, thus, in a better position to evaluate the risks inherent in different activities and to assess what can and should be done to alleviate or reduce those risks to an acceptable level. As such, it behooves safety professionals to be aware of not only safety-related heuristics that are presented to the public, but also the research that underlies that guidance to assess the appropriateness of the various safety rules that are promulgated to address potential hazards. In the real world, however, ostensible safety experts often simply accept these rules as representing appropriate, normal or typical behavior based on longevity, common sense or the simple frequency with which they are expressed.
