Plaintiff was traveling Northbound in the #1 lane of Frank Sinatra Drive in the Plaintiff's 1997 Jeep Grand Cherokee. At the time of the incident, the Plaintiff was attempting to execute a right hand turn into the main entry at The Bellagio, with the intention of traveling to the employee pick up area, to pick up a co-worker.

At the time of the incident, the Defendant was traveling Northbound at approximately 25 mph, on a portion of Frank Sinatra Drive that had been delineated for construction as a Construction Zone Access lane. At the time of the incident, the Defendant, who was apparently operating within the scope of his duties as a transit bus driver, was attempting to merge to the left to enter the designated Northbound lane of Frank Sinatra Drive.

WEXCO's Accident Reconstruction Team was retained as the Accident Reconstruction Expert, and was tasked with the determination of:

  • Applicable Vehicle Code provisions
  • Speed of both vehicles at the time of the collision
  • Delta V of the Plaintiff's vehicle as a result of the impact
  • Primary Direction of Force (PDOF) of the subject impact
  • Which vehicle had the right-of-way during the moments immediately prior to the collision
