I recently worked with an elderly woman (who I will call Beatrice) to evaluate whether or not the variable annuity she purchased less than a year ago was a good buy.

    6/16/2014 · Insurance
When thinking about life insurance, consider three realities:

    5/16/2014 · Insurance
Wanting a second opinion from someone that doesn't have an inherent conflict of interest - independence is the single greatest asset that a fee-only insurance advisor brings to the table, and because such an advisor is only compensated directly for the advice given and not based on the decisions the consumer makes, there is not an inherent conflict of interest - those conflicts are evident with anyone that is compensated on anything other than a fee-only basis for the advice given.

    4/21/2014 · Insurance
Despite the best efforts of companies and agents throughout the industry, Long-Term Care insurance (LTC) policy sales have yet to blossom as much as the industry had hoped and predicted. As the Baby Boomers continue to move through the "sweet spot" of the target market for LTC, companies will no doubt redouble their efforts in pushing LTC. Two obvious questions arise. First, is LTC right for you or your client, given the particular financial circumstances, family circumstances, and family history? Second, even if it is determined that LTC makes sense, how do you wade through the myriad of companies and policy options that are available and determine the best fit?

    3/13/2014 · Insurance
Fee-only insurance advisors serve in a true fiduciary capacity for their clients, providing independent, unbiased advice. These advisors receive no other form of compensation other than the hourly fees paid by their clients. They do not receive compensation from insurance products that their clients may decide to purchase, nor do they receive any financial incentives from steering clients toward a particular agent or company. Other than providing clients with the most knowledgeable and expert advice possible, fee-only advisors have absolutely no vested interest in the insurance decisions their clients make.

    2/10/2014 · Insurance
Without an advocate that is looking out for their best interests, life insurance consumers are at the mercy of their life insurance agents and the companies they represent. Even the most well-intentioned agents suffer from an inherent conflict of interest, as agents derive their compensation from the products they sell. A closer look at a number of areas reveals how damaging this can be to life insurance consumers:

Do you reside in Garrison Keillor's fabled Lake Wobegon? Those who own a cash value life insurance policy probably do - and probably don't even realize it! In Lake Wobegon, "all the women are strong, all the men are good looking, and all the children are above average." And any life insurance policy purchased in Lake Wobegon is no doubt better than average as well!

Oral cancer is the sixth most common malignancy diagnosed in the United States. It represents 3 to 5% of all cancers in America. This translates in over 43,000 new cases of oral cancers yearly (1996 figures). In 1996 in the U.S., there were 8,260 deaths directly attributed to oral cancer. In the state of Georgia, 680 new cases of oral cancer were diagnosed, and 190 deaths occurred from oral cancer in 1996.

As dentistry becomes more competitive, dentists are increasingly looking at unique ways to separate their practices and develop a niche. One such niche lies in the offering of patients' sedation and/or general anesthesia, commonly called "sleep dentistry" during the dental treatment. Since studies show 30% to 50% of Americans avoid the dentists because of fear issues, providing such a service appears to serve a need.

A new complication from treatment with bisphosphonates has become an important disease condition for the dental professional to recognize. Bisphosphonate-related osteonecrosis of the jaw (BRONJ) manifests itself as devitalized exposed bone in the maxillofacial region. Patients may be considered to have BRONJ, if all three of the following are presented simultaneously:

Injuries to the inferior alveolar and lingual nerve continued to be a significant source of litigation for the dental professional. Approximately 10% of cases of dental malpractice are a result of nerve injury. Perhaps the genesis of the high number of lawsuits proportional to the overall number of surgeries lies in the sequelae of a nerve injury. The sequelae can range from relatively minor annoying numbness to intractable pain and the anesthesia to the area of the nerve supply.

Supernumerary teeth in the absence of syndromes such as cleidocranial dysplasia or Gardner's is a rare event1-3. The most common supernumerary tooth is the mesiodens which appears in the maxillary midline.3 The exact etiology of supernumerary teeth is unclear but many theories exist in an attempt to explain why extra teeth are present in some individuals.

    James-Wheeler-OB-GYN-Expert-Photo.jpg
James M. Wheeler, MD, MPH, JD, magna cum laude in Biology / Psychology from Harvard, is an OB/GYN trained at Baylor, with subspecialty training in Reproductive Endocrinology / Infertility at Yale. He is also a graduate of the Robert Wood Johnson Clinical Scholars Program at Yale, focusing upon clinical epidemiology and biostatistics and health policy. He also earned his MPH at Yale majoring in Biostatistics, minoring in Maternal/Child Health. He graduated from the University of Houston Law Center with a JD in 2005, and was invited to join the Health Law division there. He has completed ADR training, having completed training programs separately in mediation, and arbitration.

Dr. Wheeler is a former national officer of the American College of Obstetricians and Gynecologists (ACOG), and served on several of their health policy committees including the Health Care Commission and the Hysterectomy Committee. He has published over 40 peer-reviewed papers on a wide array of topics in ob/gyn, with a particular emphasis on methodology. He has given over 200 invited lectures to ob/gyns, reproductive endocrinologists, radiologists, midwives, nurses, surgical technologists, law students et al. He sees himself first and foremost as a caregiver, and second to only that, as a teacher.

Dr. Wheeler has consulted in several hundred medicolegal matters for over 20 years, mostly in ob/gyn, but including family practice, internal medicine and several of its subspecialties, general surgery and several of its subspecialties, and dermatology. He has been a testifying expert before the FDA for drugs and devices, and has testified before U.S. Congressional staffers on health policy issues. He reviews for attorneys from both plaintiff and defense bars, as well as insurance companies (e.g. Pro-Assurance), and health plans (e.g. Harvard Community Health Plan). He has helped with Board of Medicine reviews, and constructing/defending class action suits. The combination of his training in medicine, basic and clinical research, clinical epidemiology, biostatistics and law make him a uniquely qualified person to review the complex issues of medicolegal cases.

Dr. Wheeler is a qualified first-reviewer, and a convincing expert during testimony. He has never been excused from a case as insufficiently expert.

  • A malpractice action requires the plaintiff to prove: (1) the defendant caregiver owed a duty of care to the plaintiff-patient, (2) the caregiver departed from that standard of care, and (3) that departure from the standard of care actually caused the injury claimed by the plaintiff. "Causation" 11; often the critical component in a malpractice action because the presence of a duty is often obvious, except perhaps in "Good Samaritan" cases, but the statutorily-required expert witnesses will argue about whether the caregiver departed from some standard of care. Because defining "causation" is difficult, there are interesting distinctions in legal versus medical, sociological, or philosophical concepts of cause-and-effect. Applying this difficult concept of "causation" to the very complex world of labor and delivery (L&D) does indeed beg the question, just how can causation be established?
