    Wanting a second opinion from someone that doesn't have an inherent conflict of interest - independence is the single greatest asset that a fee-only insurance advisor brings to the table, and because such an advisor is only compensated directly for the advice given and not based on the decisions the consumer makes, there is not an inherent conflict of interest - those conflicts are evident with anyone that is compensated on anything other than a fee-only basis for the advice given.

    Despite the best efforts of companies and agents throughout the industry, Long-Term Care insurance (LTC) policy sales have yet to blossom as much as the industry had hoped and predicted. As the Baby Boomers continue to move through the "sweet spot" of the target market for LTC, companies will no doubt redouble their efforts in pushing LTC. Two obvious questions arise. First, is LTC right for you or your client, given the particular financial circumstances, family circumstances, and family history?     Oral cancer is the sixth most common malignancy diagnosed in the United States. It represents 3 to 5% of all cancers in America. This translates in over 43,000 new cases of oral cancers yearly (1996 figures). In 1996 in the U.S., there were 8,260 deaths directly attributed to oral cancer. In the state of Georgia, 680 new cases of oral cancer were diagnosed, and 190 deaths occurred from oral cancer in 1996.

    As dentistry becomes more competitive, dentists are increasingly looking at unique ways to separate their practices and develop a niche. One such niche lies in the offering of patients' sedation and/or general anesthesia, commonly called "sleep dentistry" during the dental treatment. Since studies show 30% to 50% of Americans avoid the dentists because of fear issues, providing such a service appears to serve a need.

    A new complication from treatment with bisphosphonates has become an important disease condition for the dental professional to recognize. Bisphosphonate-related osteonecrosis of the jaw (BRONJ) manifests itself as devitalized exposed bone in the maxillofacial region. Patients may be considered to have BRONJ, if all three of the following are presented simultaneously:

    Injuries to the inferior alveolar and lingual nerve continued to be a significant source of litigation for the dental professional. Approximately 10% of cases of dental malpractice are a result of nerve injury. Perhaps the genesis of the high number of lawsuits proportional to the overall number of surgeries lies in the sequelae of a nerve injury. The sequelae can range from relatively minor annoying numbness to intractable pain and the anesthesia to the area of the nerve supply.

    Supernumerary teeth in the absence of syndromes such as cleidocranial dysplasia or Gardner's is a rare event1-3. The most common supernumerary tooth is the mesiodens which appears in the maxillary midline.3 The exact etiology of supernumerary teeth is unclear but many theories exist in an attempt to explain why extra teeth are present in some individuals.

    James M.     Dr. Wheeler has consulted in several hundred medicolegal matters for over 20 years, mostly in ob/gyn, but including family practice, internal medicine and several of its subspecialties, general surgery and several of its subspecialties, and dermatology. He has been a testifying expert before the FDA for drugs and devices, and has testified before U.S. Congressional staffers on health policy issues.   • A malpractice action requires the plaintiff to prove: (1) the defendant caregiver owed a duty of care to the plaintiff-patient, (2) the caregiver departed from that standard of care, and (3) that departure from the standard of care actually caused the injury claimed by the plaintiff. "Causation" 11; often the critical component in a malpractice action because the presence of a duty is often obvious, except perhaps in "Good Samaritan" cases, but the statutorily-required expert witnesses will argue about whether the caregiver departed from some standard of care. Because defining "causation" is difficult, there are interesting distinctions in legal versus medical, sociological, or philosophical concepts of cause-and-effect. Applying this difficult concept of "causation" to the very complex world of labor and delivery (L&D) does indeed beg the question, just how can causation be established?

    ln our current climate of economic prosperity and rising real estate values, the prevalence and usefulness of construction litigation may be on the wane. Much of the litigation and expert opinion in recent years has resulted in unrealistic repair schemes for the sole purpose of producing a settlement among parties to the litigation. When a plaintiff expert recommends a "remove and replace in its entirety"1 scenario (for example, arguing that all exterior stucco must be demolished and reinstalled due to a lack of expansion joints), the defense expert frequently advocates a more modest "fix what's broken" scheme to provide a minimum repair at the lowest cost. This process consumes considerable time and resources, and creates a difficult environment in which to craft a settlement. More often than not, neither party is pleased with the outcome; unreasonable plaintiff positions often result in settlement amounts ranging between 15 to 25 percent of the claim amount.

    Dr. Suway is a Diplomate of the International Congress of Oral Implantology and an Associate Fellow of the American Academy of Implant Dentistry. He earned his Doctor of Dental Surgery from Emory University School of Dentistry and received his Bachelor’s degree from Bucknell University. Dr. Suway also completed a one-year program in implant dentistry under the American Academy of Implant Dentistry at the Medical College of Georgia. He is licensed to practice dentistry in Georgia, Pennsylvania, and New York.

    Tracy L. Skaer, PharmD, FASHP, FASCP is a Professor of Pharmacotherapy with over 30 years of pharmaceutical experience. Dr. Skaer's research and professional experience includes pharmacy practice, chronic pain, mental health, substance abuse, and complementary and alternative medicine. She is licensed pharmacist in California, Idaho, and Washington.

    Dr. Skaer’s current research involves the use of mindfulness and multiple family group problem solving for the Treatment of Chronic Pain in those with high risk of Opioid Use. Her plans are to expand this intervention to manage chronic insomnia and post-traumatic stress disorder in children and adolescents, American Indians, veterans, and other populations.

    Other research interests include chronic pain, comorbid mental illness in chronic disease, depression, anxiety disorders, insomnia, mindfulness, complementary and alternative medicine, and pharamcoeconomics and pharmacoepidemiology. Her research has been supported by over $3.2 million in grants from foundations and pharmaceutical industry.

    Dr. Skaer has published 110 professional abstracts, 82 research papers, 43 review articles, and 6 book chapters. She serves on the editorial boards of 3 medical professional journals, Clinical Therapeutics, Journal of Sleep Medicine and Disorders, and Pain Studies and Treatment. Dr. Skaer's publications have appeared in numerous journals including, Drugs, Clinical Drug Investigation, PharmacoEconomics, Journal of Clinical Pharmacy & Therapeutics, American Journal of Medicine, Harvard Review of Psychiatry, and the New England Journal of Medicine among others.

    Alan J. Waldman, MD, has practiced Forensic Neuropsychiatry and Forensic Psychiatry for over 20 years. He specializes in the evaluation of head injuries, dementia, any type of post accident cerebral neuropathy, and any neuropsychiatric / psychiatric disorder.

    The learning and honing of Dr. Waldman's skills progressed through his stint as full time faculty at the University of Florida, his subsequent private practice, the neuropsychiatric consultant to a head injury rehabilitation and residential facility, and the medical directorship of a 217 bed State of Florida forensic psychiatric institution. While at the institution, he did consultations on the head injured patients and those suspected of malingering.

    Litigation Support - Dr. Waldman has evaluated over 400 respondents or potential respondents, for the state and defense in Florida's post incarceration sex offender program. He has testified in approximately 50 hearings and trials (again for both sides) and has been qualified as an expert in the prediction of sex offender recidivism risk. He has a great deal of experience in the detection of Embellishment and Malingering.

    Dr. Waldman has been qualified as an expert witness in circuit, county, and federal courts through out Florida. He was retained by the Office of the Attorney General of Texas in Austin for a case involving questions of malingering by a death row inmate whose case was remanded back to the Federal District Court in Austin by the U.S. Supreme Court. Dr. Waldman has testified in courts in California, Illinois, New Jersey, Ohio, Maryland, New Hampshire, and Texas.
