Other factors are pre-existing mental and physical illness, competency and capacity (e.g. dementia, Intellectual Disability.) As a physician, Dr. Adhia is uniquely qualified to review medical records and doctor reports. Institutional medicine, medical malpractice, and standard of care, apply to both public and private facilities, including government regulated correctional institutions and psychiatric hospitals. Drug-Facilitated Sexual Assault (DFSA) is the use of drugs and/or alcohol by a sexual predator to render a victim incapacitated and unable to fight back against a sexual assault. A side effect of many "Date Rape" or "Club Drugs" is also anterograde amnesia, the inability to recall what happened while drugged, increasing a predator's belief he will "get away with it." Those odds are shifting, but attorneys, Courts and potential victims are better served if they understand some of the drugs used and their impact on mind and body.

    Officers throughout the United States and perhaps internationally have heard use of force instructors discuss the "21 Foot Rule" during their officer safety, firearms and deadly force training. As both a use of force instructor and practicing forensic police practices expert, I have also trained and testified to this concept myself.

    On a hot July day, fire and police are called to the home of a 55 year old man suffering from heat stroke. Police arrive first and find the man sitting on a bench in his front yard. When the officers approach the man and ask him to give them his cane, he becomes agitated and non-compliant. One officer suddenly grabs the cane away from the man, who screams and suddenly stands up. The man is tased, taken to the ground, beaten and handcuffed. He is transported to the hospital where ER physicians confirm a diagnosis of heat stroke. The man has no criminal history. He sustains numerous moderate injuries which keep him from returning to work for several weeks. The officers and agency are sued and settle out of court.

    Lenard Vare is a Corrections Expert with over 27 years of experience managing and operating small to large Prisons and Jails. He earned a Masters degree in Justice Management and a Baccalaureate in Criminal Justice Administration.

    Mr. Vare retired at the level of Warden from the Nevada Department of Corrections and managed the operations of four prisons which housed inmates of varying classifications from minimum custody to maximum security in both male and female institutions. He retired after serving 10 years as the Director of the Napa County Department of Corrections which oversees all corrections functions in the County.

    Mr. Vare has taught various classes in emergency management and preparation to a number of law enforcement agencies, audited numerous jails and prisons for adherence to policies and procedures, conducted internal affairs investigations, and oversaw the construction of a new prison and rehabilitation and reopening of a older facility to ensure that all standards were met prior to occupancy. He also has over six years of experience teaching criminal justice classes in an undergraduate program.

    On June 14, 2013, the nation paused to pray and remember the unspeakably horrific shooting, a massacre that claimed 26 lives, on December 14, 2012, at the Sandy Hook Elementary School, in Newtown Connecticut. The cruel irony, as legions of the country's experts, myself included, continue to engage in differential diagnoses and soul-searching for answers as to who and what went wrong, is that Sandy Hook Elementary School probably could not have done anything more, different or better, to protect its students.
