Background Experience - Prior to joining Warren, Mr. Duncan worked for 23 years as a South Carolina Highway Patrol Trooper to include 10 years as a Multi-Disciplinary Accident Investigation Team (M.A.I.T.) member. As a trooper, he investigated in excess of 1,000 vehicle accidents and incidents. Then, as a member of M.A.I.T. for 10 years, he was involved in over 1,000 detailed investigations and collision reconstructions. Mr. Duncan is a member of the South Carolina Association of Reconstruction Specialists (SCARS), the International Association of Accident Reconstruction Specialists (IAARS), and the Blue Knights International Motorcycle Group. He holds a Bachelor of Science Degree in Political Science from Lander University in Greenwood, South Carolina and completed the Law Enforcement Basic Program at the South Carolina Criminal Justice Academy in Columbia, South Carolina. 

Mr. Duncan has testified multiple times in state courts and he has been court qualified as an expert in accident investigation and collision reconstruction. His expertise focuses on investigating and reconstructing vehicle collisions involving single and multi-vehicles, animals, pedestrians, motorcycles, heavy trucks, and commercial vehicles. Event Data Recorders (EDRs) were first introduced by General Motors (GM) in 1974. That data was only available to GM; however, since 1994 more and more vehicle EDR’s have recorded data that can be gathered. The data captured can be imaged and is being used by vehicle manufacturers, law enforcement officers, and collision reconstructionists to better understand what is happening in a collision. In accident investigation, EDRs have the potential to provide independent measurements of crash data that would elsewise be estimated by reconstruction methodology.

    Many automobile accidents are complex cases with multiple events during a single accident. The aim of forensic investigations of such (and all other) accidents is to reconstruct the sequence and the severity of events during the accident and then to establish cause and- effect relationships between the injuries (or damages) and the probable factors - vehicle design (e.g. brakes, structure, airbags); vehicle operator (e.g. distracted driver, alcohol impairment, reduced vision); and operating conditions (e.g. fog, failed traffic sign, excessive speed, icy road).

    Hybrid cars have been on US roads for many years, starting with Honda InSight (1999) and Toyota Prius(2000) in mass production.

    In crashes between two automobiles, it is generally assumed that the lighter vehicle will suffer more damage and that its occupants will suffer higher levels of injury.

    This article contains a few of the findings from our recent study of automobile safety in frontal crashes. Parts of the data analyses are presented but details such as the relationship of a particular design feature to the measured injury indicators are highly dependent on specific cases and are available only for individual discussions.

    The New Car Assessment Program (NCAP) conducted by the National Highway Traffic Safety Administration (part of the U.S Department of Transportation) underwent major changes recently. For automobiles designated as model years 2011 and later, the changes involve both what is measured and what is published.

    Over the years, there have been several product liability litigations regarding pedestrians being injured and the front structure designs of the vehicles being alleged as the significant factor.

    The structural behavior of automobile seats and seatbacks is one of the factors often examined in investigating injuries to a vehicle's occupant(s) in crashes.

    Airbags in modern automobiles have been around for many years and their record in improving occupant safety in crashes is generally well accepted. However, many questions still arise regarding their deployment and performance in crashes.

    In essence, to warn is to place someone on advance notice of a danger or a potential danger. To warn requires that the person or people giving the warning have a superior knowledge of the harm or potential harm compared to the person or people exposed. Further, the person or the people who are warning must also have a superior knowledge of the means of reducing either the likelihood and/or the magnitude of the harm or potential harm as compared with the person or people exposed.

    Air bag control modules utilize complex algorithms to make air bag deployment decisions based on crash severity related to the change in vehicle speed or deceleration over time. Due to the proprietary nature of air bag deployment algorithms, the velocity, acceleration, or displacement thresholds for air bag deployment during a collision are not easily obtained; however, a range of frontal barrier impact speeds and corresponding deceleration and displacement threshold values for air bag deployment can be approximated using known vehicle stiffness-to-weight ratios.

    Jeffrey C. Fox, PhD, MBA, MS, BLS, AAS, CHPA IV, CHS IV, served for 32 years in the field of Public Safety, 21 of which were with the VA State Police. He has over 20 years of personnel, administrative, and program management experience. Dr. Fox was a member of the American College of Forensic Examiners Institute where he holds a Level 4 Homeland Security Certification. He has completed the Federal Emergency Management Agency Professional Development Courses and was certified through the Virginia Department of Emergency Management as a trainer for incident command system training courses. As a practitioner, he was involved in the response and management of all types of events such as major disasters including floods, hurricanes, snow/ice storms, and the largest traffic crash in Virginia history. He has also managed and responded to civil unrests, protests, a sniper attack, dignitary protection, special event planning, and many major crimes.

    Background - Dr. Fox began his law enforcement career as a military policeman in the U.S. Army and served as a town police officer, trooper, sergeant, first sergeant, and lieutenant. He served as a field lieutenant with the VSP and served as the assistant training officer where he managed the daily operations of the training academy. He also served as the statewide incident management program manager for the VA Department of Transportation in the operations and security division. 

    Teaching / Speaking Experience - Dr. Fox retired from state service as the Program Coordinator and Assistant Professor for the Homeland Security & Emergency Preparedness and Criminal Justice Cohort Programs for VA Commonwealth University. He served as an Assistant Professor and Chair of the Public Safety Adult Degree Completion Programs (Bachelors) [Criminal Justice and Homeland Security & Emergency Management] for Bluefield College. While the assistant training officer for the VSP, Dr. Fox collaborated with the University of Virginia and together they created the National Criminal Justice Command College. Having spent 20 years instructing at various criminal justice academies in a plethora of criminal justice, instructor development, and leadership courses, Dr. Fox has taught over 560 criminal justice and homeland security / emergency preparedness courses, and management / leadership courses which include over 18,000 classroom hours. He has taught over 85 criminal justice topics in police academies, which include over 4,000 hours of classroom instruction. Dr. Fox has served on over 35 boards or committees relating to criminal justice, homeland security, or training issues. He was tasked with overseeing the implementation of NIMS compliance issues for two large state agencies totaling approximately 6,000 employees. He has also overseen the development of several large distance-learning programs. Dr. Fox served as chairperson and committee member for many doctoral students in the public service leadership discipline. During his public service career, he earned over 167 commendations, awards, and honors for enforcement and service work, public speaking and instructing, and his academic achievements.

The problem addressed was that it is currently unknown whether there is a dominant leadership style associated with incident commanders during an incident.
