Richard T. Picciochi is a Questioned Document Examiner with over thirty years of experience in the New York City Police Department Crime Laboratory and in private practice. He is retired from the NYPD Forensic Investigation Division where he was a Detective, Document Examiner and the Technical Supervisor of the Questioned Document Unit. In the course of his career he has examined thousands of disputed signature, handwriting and document cases, participated in numerous high profile investigations and testified in trials including the "Zodiac" homicides and the first terrorist attack on the World Trade Center in New York City.

Mr. Picciochi possesses a background that integrates the academic sciences, applied forensic sciences and law enforcement investigations. He has earned a Master of Science degree in Forensic Science and has received extensive specialized training in questioned document analysis by the NYPD, the FBI and the United States Secret Service.     Recordings involving cellular telephones or personal digital assistants (“PDAs”) are increasingly the source evidence in audio forensic examinations, compared to recordings originating with other devices such as hand-held digital recorders. On modern PDA cellular telephones recordings can be made either directly to the telephone or transmitted as voice mail messages. The current investigation focuses on differences in the two types of recordings in terms of dynamic range and linearity of levels. Such information can be important for characterizing the distance of sound sources relative to the microphone and are important for understanding transformation of recorded speech and non-speech sounds.

    If you do work as an expert witness on warnings, you probably feel quite confident that you know a bad warning when you see one (and would know a good one if you ever saw one). Of course, backing up our opinion with some version of, "I just know" doesn't make for very strong testimony. Indeed, we can count on our criteria being challenged by opposing council even when we can articulate them.

    My first expert witness case involved a man who was injured using a chinup bar designed to fit within a door frame. The bar has rubber suction cups at each end, and its length is adjusted by twisting its two sections together or apart for a telescoping effect.

    Occasionally, the document examiner encounters a signature or writing that is believed to be a forgery but in reality was written by a blind or visually impaired individual. There are various features of blind writing that could initially be mistaken for a forgery, so it is understandable that this could occur.

    Before the fountain pen began to be widely used in the late 1800s, writing was mainly done at a desk with a steel nib pen that constantly had to be dipped into an inkwell. The fountain pen, which was designed to carry its own ink supply, brought greater convenience and portability to the writing process.

    Officers throughout the United States and perhaps internationally have heard use of force instructors discuss the "21 Foot Rule" during their officer safety, firearms and deadly force training. As both a use of force instructor and practicing forensic police practices expert, I have also trained and testified to this concept myself.

    On a hot July day, fire and police are called to the home of a 55 year old man suffering from heat stroke. Police arrive first and find the man sitting on a bench in his front yard. When the officers approach the man and ask him to give them his cane, he becomes agitated and non-compliant. One officer suddenly grabs the cane away from the man, who screams and suddenly stands up. The man is tased, taken to the ground, beaten and handcuffed. He is transported to the hospital where ER physicians confirm a diagnosis of heat stroke. The man has no criminal history. He sustains numerous moderate injuries which keep him from returning to work for several weeks. The officers and agency are sued and settle out of court.
