Facilities which utilize hazardous liquids and gases represent a significant potential liability to the owner, operator, and general public in terms of personnel safety and preservation of assets. It is obvious that a catastrophic incident or loss of property or personnel is to be avoided at all costs. This book was conceived to give the reader a guide to understanding the requirements of the various codes and regulations that apply to the design, construction, and operation of facilities utilizing hazardous materials in their processes.

Attorneys use experts in two ways. First is the traditional use of an expert as a witness in court. In this role, scientists, business people, or others with technical knowledge are retained by attorneys primarily for their opinions (oral, written, or both), ultimately to be given at deposition and in civil and criminal courts. Second, the expert may be used as a pre-trial consultant or more specifically as an undisclosed consultant
"Miracles" reveals truth from Scripture, science and life. Everything that is or was or is to come is part of God's miracle. Science says that nothing is miraculous- Time and Chance created the universe with no meaning or purpose. God's universe has great meaning extending from the stars to atoms and to you. What we believe about miracles can be a source of great joy or missed joy in our lives. Dr. Brown, a Christian and author of over 100 scientific papers, has coined a new word, synscicretism, to call attention to the doctrine that today elevates science above religion. Science works best for the great "how" questions, but poorly for the great "why" of all things.
This authoritative guide is designed to achieve a synthesis of understanding and effort between case science and case law. It examines all stages of attorney/expert interaction from the initial interview to post-trial evaluation.

The technological singularity described by futurist Ray Kurzweil is the phenomenon when technology supercedes the human intellect . The current ascent to singularity is at an exponential rate (Law of Accelerating Returns) due mainly to escalating computing power (Moore's Law), and is estimated to occur by the year 2045 or sooner.
This is an academic dividend of the popular Pediatric Cardiology Review biannual course that was started by Dr. Chang and Dr. Eidem. The book contains over 875 questions & answers and is geared toward pediatric cardiologists taking the boards or maintenance of certification, pediatricians, and cardiologists interested in freshening their skills. Ray Horak provides litigation support as a consulting expert and testifying expert in cases involving the Telephone Consumer Protection Act (TCPA), product/service misrepresentation, contract disputes, and intellectual property (patent, copyright, and trademark/service mark infringement) disputes, as well as issues of taxes and fees allegedly owed to 911 districts and municipalities. Those cases have involved a broad range of technologies, including Automatic Telephone Dialing Systems (ATDSs), text messaging, cellular, DSL, E911, fax, PBX, prepaid cellular, push-to-talk (PTT), videoconferencing, VoIP, and voice processing.
He also has performed numerous technical compliance reviews of the telephony systems that financial institutions and survey companies and their third party vendors employ in sales, collections, customer service and opinion polling. The objective of those engagements, several of which are ongoing, is to determine the specific nature and capacities (present, potential and theoretical) of the telephony systems (e.g., ATDS and PBX) and subsystems, the systems of record (i.e., databases), Customer Relationship Management (CRM) systems, Receivables Management (RM) systems, and any and all other peripheral systems, both premises- and cloud-based.
Ray is an Independent Consultant with a General Practice in Wireline and Wireless Telecommunications and Related Fields such as the Internet and Voice over IP. His 45 years’ experience includes management and executive positions with Southwestern Bell, CONTEL, and Executone. Ray authored the best-selling Communications Systems & Networks, (John Wiley & Sons), Telecommunications and Data Communications Handbook (Wiley-Interscience), and Webster’s New World Telecom Dictionary(Webster’s New World). Previously, Ray was Senior Contributing Editor for Newton’s Telecom Dictionary (12th through 21st Editions). He has written hundreds of technical white papers, case studies, articles, and columns for major print and electronic publications such as CommWeb, Computer Telephony, Datapro, Network World, The Prepaid Press, Teleconnect, and Telecom Reseller. Ray also has served as Technical Editor for several book-length works, including Deploying Secure 802.11 Wireless Networks with Microsoft Windows (Microsoft Press, 2003).
Not particularly surprising to those of us who work in the TCPA domain or are impacted by it, the published articles, blogs and such are mostly, if not all, written by attorneys in the defendants’ bar. I reckon those in the plaintiffs’ bar like to keep their opinions, musings and strategies to themselves until the litigation process begins. I provided some TCPA background and context in a previous article, TCPA: Facebook v Duguid, but will repeat some of that here to refresh your memory.
The decision of the Supreme Court of the United States (SCOTUS) in the matter of Facebook v Duguid has been perhaps the single most anticipated in the realm of the Telephone Consumer Protection Act (TCPA), at least in the last decade or so, and all over a punctuation mark - a comma, to be exact.
The Telephone Consumer Protection Act (TCPA) was passed into law in 1991. At the time, consumers were plagued by sales calls which it seemed always came at the most inconvenient times...In an effort to address a growing number of telephone marketing calls and certain other telemarketing practices...
Most of us know, at least in general terms, about the restrictions on unsolicited telemarketing calls to consumers and the national Do-Not-Call (DNC) list designed to end those annoyances...or opportunities, depending on your perspective. Just to refresh your memory, the TCPA states "It shall be unlawful for any person within the United States, or any person outside the United States if the recipient is within the United States—(A) to make any call (other than a call made for emergency purposes or made with the prior express consent of the called party) using any automatic telephone dialing system [ATDS] or an artificial or prerecorded voice
In an effort to address a growing number of telephone marketing calls and certain other telemarketing practices thought to be invasions of privacy, Congress enacted the Telephone Consumer Protection Act of 1991 (TCPA), codified at 47 U.S.C. § 227.
An instant classic and a best seller, with more than 65,000 in print. It served as the basis for Horak’s more contemporary works, Telecommunications and Data Communications Handbook (2008) and Webster’s New World Telecom Dictionary (2007).
A comprehensive and authoritative telecommunications dictionary of more than 4,600 terms essential to a clear and thorough understanding of voice, data, video, and multimedia communications system and network technologies, applications, and regulations. Webster’s is an absolutely unimpeachable resource written by a recognized expert in the field. Webster’s enjoys great critical acclaim, as do all of Horak’s works.
The one book you’ll need to understand the entire telecom landscape, from copper to fiber, wireline to wireless, LANs to MANs to WANs, TDM to IP, AAL to Zigbee and everything in between. Written in a plain-English, commonsense style by an authority on the subject, this critically acclaimed book is at just the right level for the serious professional who wants to get at the whole truth—without the math.

If you do work as an expert witness on warnings, you probably feel quite confident that you know a bad warning when you see one (and would know a good one if you ever saw one). Of course, backing up our opinion with some version of, "I just know" doesn't make for very strong testimony. Indeed, we can count on our criteria being challenged by opposing council even when we can articulate them.
My first expert witness case involved a man who was injured using a chinup bar designed to fit within a door frame. The bar has rubber suction cups at each end, and its length is adjusted by twisting its two sections together or apart for a telescoping effect.
In this volume, recognized scholars discuss ways they have applied communication research to court cases as an expert witness or consultant in such areas as jury selection, pretrial publicity, sexual consent, warning adequacy, hindsight bias, jury decision making, document authorship identification, graphics and simulations and several others. For attorneys, the volume may provide an introduction to ways that communication scholarship can inform their future cases.
This book offers solutions for communication problems that erupt in our daily lives. By focusing on socially meaningful applied research in communication, this book offers a new direction for interpersonal communication studies. Featuring original studies that are practical and relevant, chapters provide readers with a balanced combination of rigorous research with pragmatic application.
PRACTICE AREAS AND EXPERTISE: Peacemaking, mediation and conflict management of difficult community, business and interpersonal conflicts.

He has mediated over 400 difficult and complex conflicts including employment disputes (gender discrimination, racial discrimination, wrongful termination) construction defect cases, complex commercial and industrial construction disputes, CERCLA claims, partnership dissolutions, water rights disputes, shareholder disputes, intellectual property litigation, constitutional law cases, land use disputes, financial and commercial disputes, crop losses, estates and trusts litigation, and insurance disputes.
Let's consider what makes this time slightly different than previous times of unrest. The essential facts are that most Americans are suffering through the deepest economic depression since the 1930s. We barely avoided a complete economic collapse and may still see an economic collapse if the euro fails.
I am reading The Truth About Camp David: The Untold Story about the Collapse of the Middle East Peace Process by Clayton Swisher. This is a modern history of the events in the Clinton administration from 1999 to 2000 concerning US attempts to mediate peace between Israel and Syria and Israel and the Palestinians.
In this in-depth analysis, professional mediator Douglas E. Noll goes behind the headlines to understand why crucial negotiations fail. He argues that diplomats often enter negotiations with flawed assumptions about human behavior, sovereignty, and power. Essentially, the international community is using a model of European diplomacy dating back to the 18th century to solve the complex problems of the 21st century. Through numerous examples, the author shows that the key failure in current diplomatic efforts is the entrenched belief that nations, through their representatives, will act rationally to further their individual political, economic, and strategic interests.
Sex, politics and religion at the office are potent forces for attaining a sustainable competitive advantage in the post-modern workplace. Whether you are in charge of a Fortune 500 company, a nonprofit, an entrepreneurial enterprise, or just a few workers, if you are sweeping sexuality, political power, and values under the rug, you're leaving three powerful tools in the shed. Repression is not an option. In contrast, the rewards for developing a powerful, healthy workplace are profitable, reliable, and limitless. This unconventional approach, developed by authors John F. Boogaert and Douglas E. Noll, shows you how to unleash the incredible power of sex, politics and religion in your office.
In this book, Noll weaves many strands of academic thinking about human conflict into an integrated view of why people fight, how they fight, what they fight over—and how they can instead make peace, whether in the courtroom or beyond.

Here's how businesses can institute new polices requiring all employees to participate in fun and informative workshops to overcome ageist assumptions about younger workers or seniors. Get rid of prejudices and limiting beliefs that prevent camaraderie, productivity, and profits.
Age discrimination is a global phenomenon and perpetuates unfair, unjust and untrue stereotypes of seniors. Corporations think they are saving money by replacing older workers with younger ones. Cheaper doesn't mean better. Widespread lawsuits claiming and proving ageism are a way seniors can fight age discrimination and change laws.
If not dealt with, addiction can be a greased pole to self-destruction and bankruptcy. For people in powerful positions, such as CEOs, doctors, executives and company founders, attempting to conduct business without the use of their full faculties is a very dangerous proposition.

In recessionary economies, losses would be about 12% to 15% (S&P 5000) versus 49% in 2000 and 57% in 2008. Dr. Moody cautions novices against attempts by Planners, Brokerage Firms, Advisors, Analysts, State securities and insurance offices, ERISA, Consumer Federation Protection Bureau, SEC, FINRA, Department of Labor, Consumer groups (AARP, Consumer Federation of America) 401k plans, and general instruction, to clearly define theElement of Investment and Insurance Risk.
This article asserts that investor problems are caused primarily by one major issue - lack of knowledge. Knowledge is woefully nonexistent at all levels in American financing, investing, and retirement planning. This article examines the various recent systemic failures that demonstrate how lack of knowledge, along with forces and incentives, continue to promote system failure despite its grievous impact on individuals, especially the elderly who
What’s the issue? The inverted yield curve. The great injustice to all is that this fact was known by (apparently) just a few due to poor initial licensing instruction/knowledge as defined by the SEC/FINRA (where there is nothing on how to use a financial calculator) and inadequate continuing education by the planning organizations (CFA, CFP, ChFC, CPA et al;) overseeing their memberships. (And it made little inroads with my students in 1999.
There really ain’t none. You are going to find that most texts actually do not address risk properly. This is the type of graph in instruction and it can include other sub categories. Low speed motor vehicle collisions are a common occurrence. The use of cellular phones, text messaging, and e-mailing while driving has only increased the frequency of low speed motor vehicle collisions. A motor vehicle collision where there is only minor damage to the vehicles may result in personal injury claims for substantial sums.
In toxic tort litigation, a person is often claiming to have developed cancer or some other serious disease due to having been exposed to a particular substance. Determining if the exposure to the substance was the cause of the disease is often a central focus of the litigation.
It is a common error that an attorney retains the wrong type of expert to testify in a lawsuit. This error is particularly common when the expert is a medical specialist. It is widely believed that a medical doctor who specializes in a particular organ system is qualified to formulate opinions and testify as to all issues concerning that organ system.
