    Mr. B was a 75-year-old man who had made a will in 1995 naming his two sons as equal beneficiaries of his estate after his death. In 2004, he married Ms. M. On August 11, 2008, he was diagnosed with brain cancer, for the treatment of which he was hospitalized. On September 3, 2008, he signed a new will that Ms. M had procured for him, naming her the sole beneficiary of his estate after his death, to be subsequently given to his sons after the event of her death. Mr. B passed away on September 29, 2008. His sons subsequently sued Ms. M, alleging that Mr. B did not have testamentary capacity when he signed his new will. His attorney consulted me to review his medical records to assess Mr. B's mental state, testamentary capacity, and vulnerability to undue influence.

    Facts of the Case: Ms. P was a 91-year-old, widowed, Caucasian woman with a history of Parkinson's disease who was diagnosed with metastatic colon cancer after she was found down in her bedroom, where she had fallen and broken her arm. It was decided by her physicians that it was best to not pursue chemotherapy, radiation, or surgery. A colostomy bag was placed, and Ms. P was placed on home-based hospice care, with an emphasis on comfort care measures.

    An ever-increasing number of plaintiffs are claiming post-traumatic stress disorder. Why such a sudden, marked increase in litigation of this form? Post-traumatic stress disorder (PTSD) was first described in the sixth century B.C. The symptoms associated with the illness have not changed, though the name of the condition itself has, naturally, changed. In World War I the disorder was labeled "shell shock," linking the condition to the close lines between battling armies and the continuous firing of munitions. In World War II, the condition came to be called "combat neurosis." The term "post-traumatic stress disorder" entered the psychiatric nomenclature with the 1980 publication of the Diagnostic and Statistical Manual of Mental Disorders, 3rd Edition.

    A report of shots fired at the Navy Yard in Washington, D. C. brought a huge response from law enforcement from all areas. The response was immediate and overwhelming. As it turns out, the report was false. The incident remains under investigation at the time of this writing.

    Coordinating security for corporate offices, hotels, apartments, convenience stores, and just about every other possible location can have its challenges. Coordinating security at major events, however, is especially challenging. This article will focus on some of the challenges I faced when coordinating security for several events and locations in Houston, Texas for Super Bowl XXXVI.

    Not long after I promoted to sergeant, I was training in a patrol division. I was riding with another sergeant when we received a call from two patrol officers. They were at an apartment complex and had chased a male into an apartment. They requested a supervisor go by with them. So, as part of my training, we went.

    I have read a number of books, studies, and court cases in my career to support the fact that eyewitness identification, by itself, is never sufficient enough to send a person to prison. This is not news. Over the past 20 years, more and more people are being exonerated for violent crimes due to DNA . This article is not to rehash old arguments. Instead, it is more of a reminder to investigators everywhere to not finalize a case, charge a person, and send them to prison based solely on an eyewitness' identification.

    During my 22-year law enforcement career, I became involved in countless situations in which I personally dealt with people in mental health crisis. My first incident involved a Hispanic male armed with a pistol. I learned a significant amount from that single incident: so much, in fact, that I made the decision to join the Houston Police Department's Hostage Negotiation Team. The techniques I have learned over the years can be applicable to almost anyone, at any time, in just about any situation. In the following paragraphs, I will recount a few incidents in which I was involved and discuss the techniques used to end each the situation safely. Understand that this is not a specific "how-to guide" that may be applied to every situation. Instead, the use of these techniques will simply allow a person that becomes aware of a certain situation - to be able to attempt to stabilize the incident prior to first responders' arrival.

    Robert Daley, PhD, is a former Director of Psychological Services for the New York City Police Department and a Forensic Psychologist with over 30 years of experience in working with law enforcement and public safety personnel. For 25 years, Dr. Daley has been successfully assisting candidates in Appealing Fitness-for-Duty Disqualifications for all the major New York metropolitan area law enforcement agencies.

    Background - A leader in his field, Dr. Daley has directed the pre-appointment psychological screening of 1,000s of New York City Police Officers and developed the first psychological screening program for New York City Fire Department Firefighter recruits, and for the promotion of firefighters to the position of armed Fire Marshals.

    Dr. Daley was the consultant to the New York State Office of Court Administration in the development of their psychological screening process for prospective New York State Court Officers. He continues to serve as the principal psychological consultant to two large private security forces.

    Dr. Daley has lectured at the FBI Academy and addressed the International Association of Chiefs of Police on police and law enforcement issues. He has also been interviewed by representatives of the mass media on these and other topics.

    In addition to his work with the law enforcement community, Dr. Daley has supported the larger legal community with expert assessment and court testimony concerning a wide variety of psychological issues. Questions of false or coerced confession to criminal activity, victimization by sexual harassment or police misbehavior, posttraumatic stress disorder arising from a variety of causes, and the validity of threats against the President of the United States, are among the issues professionally and successfully addressed.

    Litigation Support - For over 20 years, Dr. Daley has provided psychological screening for detective investigators employed by the District Attorneys of four of the five counties comprising New York City, and provided Fitness-for-Duty Evaluations for these agencies.   • For many individuals contemplating treatment for addiction, ninety or more days of residential treatment can be a daunting thought; even difficult for some to consider beyond the once-mainstay "30 day" inpatient treatment program. While many programs still use this "30 day" model, this duration was not based on research or science. It was simply the time period that insurance carriers agreed to provide coverage in the 1940-s and 1950-s, and so was adapted as the model for treatment.
