Andre S. Watson, PsyD, is a Child, Adolescent, Family, and Couples Psychologist in active clinical practice. Legally blind since age 9, he specializes in adjustment to Blindness and other sensory and physical disabilities.

Dr. Watson conducts individual short and long-term therapy with patients dealing with various DSM diagnoses, chronic mental health issues, adjustment disorders, post-traumatic stress disorder, and relationship problems. He delivers child, family, and couples’ psychotherapy with diverse and underserved populations. Dr. Watson also facilitates adjustment to blindness groups for blind adolescence with the Overbrook School for the Blind. For this, and his dedication to his field, he was honored with the “Excellence in Empathy” award from Widener University.

Dr. Watson has significant teaching and public speaking experience. He delivers speeches to audiences, patients, colleagues, and readers about adjustment issues and the social and emotional changes that individuals and families may expect with a disability. Dr. Watson is the author of the book, Vision in the Dark: How Living in the Dark taught me to see the light. An accomplished athlete, he participated in the 2008 Para Olympics in Beijing, China for Judo.

    In order for a medical opinion to be admissible as evidence in civil, criminal and administrative cases, the basis of the opinion must fulfill either the Daubert Criteria or the Frye test, depending on the jurisdiction. The judge of the court rules on the admissibility of the expert opinion. The effect of Daubert has been to limit expert testimony to opinions which are based on a scientific foundation. Daubert specifies that adequate scientific support and method and a known error rate must exist. The testimony of a mental health expert rendering an opinion using criteria which does not meet Daubert standards is weakened by the implication that it is not based on "sound science." In some instances, for example, a mental health expert uses an approach where there are no peer-reviewed studies or methods, such as when psychologists compose their own neuropsychological test batteries. In most cases where an attorney is considering a "Daubert challenge," a contemporaneous and up-to-date literature search is indicated. Also, extensive case law presently exists as to specific issues. Being familiar with the Daubert criteria enhances effectiveness in challenging a mental health expert's opinion, whether on voir dire or cross examination. On direct examination, the strengths of an opinion reached under Daubert criteria become a "teaching moment" for the trier of fact, because it will be founded on the science of mental health assessment.

    The medical expert cannot express an opinion about the ultimate question to the trier of fact: how much is the plaintiff's emotional distress (emotional injury) worth in dollars? Yet when the question of these monetary damages is put to a jury, their deliberations are better-served if considered in the context of a Forensic Psychiatrist's knowledgeable findings and testimony.

    There appears to be little question that pain represents a significant American public health problem. A recent Gallup poll reported that an estimated 26 million Americans suffer with severe pain, with half of those reporting daily occurrence. Six in ten Americans with severe or moderate pain have lived with the condition for at least seven months. More than half report poor pain control despite having consulted with physicians. Interestingly, four in five Americans believe that aches and pains are a natural part of getting older, and 64% will see a doctor only when they cannot stand the pain any longer.

    Every attorney involved in criminal cases inevitably encounters a client who's accused of a sexual crime. Despite believability, it is one of the few crimes when the client is presumed guilty until proven innocent. Regardless of the attorney's role in the case it is imperative that attorneys understand the purpose of psychosexual evaluations (PSE), which client is a good candidate for the PSE, when they should be administered, and who provides such evaluations.     Forensic psychological evaluations have become a valuable resource for the criminal justice system by addressing important forensic questions. For instance, assessing risk for violence can help courts make appropriate decisions on issues such as sentencing, granting privileges, and community reintegration. If an individual is assessed to be a high risk for future violence, a judge has grounds to order a more restrictive setting compared to someone who is a lower risk for recidivism. By tailoring court decisions based on accurate psychological evaluations, the community is safer while the defendant's rights are also protected.

    When minors violate a criminal statute, they enter the juvenile justice system rather than the adult criminal system. Although differences exist, both court systems recognize the competency to stand trial law.
